I do not have money for a lawyer but I need one to help me on a specific day only or write some papers for me?
Hypothetical: You show up in the courtroom on the day of your case hearing. You spouse is asking for support, a residence exclusion order, and sanctions against you. Your spouse did not have a lawyer. All of a sudden a person in a suit bustles into the courtroom dragging a huge briefcase on wheels and hands a document to you which reads, 'Substitution of Attorney' - your spouse now has a lawyer. Behind the person in the suit is an exhausted-looking associate carrying four three-inch binders - all about you and your case! It seems they know more about you than you know about yourself! The lawyer has a pad and is writing while your spouse is giving the new lawyer instructions and the lawyer furiously makes page after page of notes. Pages fly. You feel overwhelmed. Someone in the courtroom whispers that this lawyer is well-known and has offices in Century City, San Diego and Santa Barbara. The judge calls the case and the lawyer starts with a long argument. Suddenly more binders have appeared on the table. People in the courtroom gasp and sigh as the lawyer speaks - and the tone of the voice is a like a raging lion. You understand none of the argument which mentions cases, rules of court, and deadlines. You thought that because you showed up to the courtroom that was enough - you filed no papers at all. You have never seen such a thing. The judge asks you if you need time to get a lawyer. You only earn enough money for rent, food, a car-payment, insurance, and some utilities and most lawyers who you called wanted at least $7,500 to start.
California Rule of Court 5.145 Allows Attorneys to Unbundle a Service and Just Help You on a Limited Basis
Rule 5.425. Limited scope representation; application of rules. (a) Definition. "Limited scope representation" is a relationship between an attorney and a person seeking legal services in which they have agreed that the scope of the legal services will be limited to specific tasks that the attorney will perform for the person. (b) Application. This rule applies to limited scope representation in family law cases. Rules 3.35 through 3.37 apply to limited scope representation in civil cases. (c) Types of limited scope representation These rules recognize two types of limited scope representation: (1) Noticed representation. This type occurs when an attorney and a party notify the court and other parties of the limited scope representation. The procedures in (d) and (e) apply only to cases involving noticed limited scope representation. (2) Undisclosed representation. In this type of limited scope representation, a party contracts with an attorney to draft or assist in drafting legal documents, but the attorney does not make an appearance in the case. The procedures in (f) apply to undisclosed representation.
What Does This Mean?
The law allows you to taylor your representation. A lawyer who is not the attorney in the case might charge you hourly to draft a FL -150 or FL -320 - some of the most commmonly used documents in Family Law. Or the lawyer might charge your hourly just to show up on one day in the courtroom. The form needed to do this, is FL-950. You and the lawyer need to sign the form and send a copy to the court. If the lawyer is ghosting, this means writing your documents for you with your name on the pages as your own attorney, no notice is required.
Issues with Limited Scope Representation
You might still get letters from the court; you might still be served with papers; you might still go to court alone, unless the limited scope contract indicates otherwise. Lawyers under a limited scope contract might also have less opportunity to fully understand the entirety of the case, because they are less involved. Some lawyers will not take cases on this basis, simply because it is sometimes more confusing and complicated to do only a part - than it is to the whole - much like icing only one slice of cake.
